A non-refunadable deposit of £50 per rider is required when booking your tour.
The balance of the total cost must be paid at least 21 days prior to the tour date.
Cancellation policy: if the tour is cancelled within 3 weeks of the planned date of commencement then there is no refund due. If it is cancelled before this time a full refund minus 10% administration charge will be granted. This is a generous offer and reflects the fact that we know it can be difficult to fit trips away in with day-to-day life and unforeseen things do happen.
The company reserves the right to cancel any rides/tours without notice. This will only happen due to extreme circumstances and all monies paid by the client will be refunded in full.
Before the tour commences, the client agrees to follow all instructions on riding procedure as laid down by the tour guide. We do not normally charge clients for damage caused to the bikes, however if these instructions are not adhered to then the client becomes liable for the damage caused.
The client must hold a current, valid full motorcycle licence and must inform us at the time of booking of any endorsements.
The client must produce their passport, motorcycle licence and EHIC (previously known as form E111) or equivalent medical insurance paperwork on arrival, and a photocopy of the latter.
The client agrees that due to the nature of the tour, no responsibility can be accepted by the company or any agents assisting them for any accident or personal injury suffered by the client and for that reason the client is specifically asked to take out personal insurance that provides cover for medical costs and repatriation. You will be asked to sign a disclaimer to this effect before the riding commences.
For the duration of the ride/tour, the client agrees to conform to all regulations in place concerning the use of drink and drugs whilst riding and any client found to be under the influence of any of these substances will be asked to leave the tour with no refund. Also any behaviour of any individual deemed to be detrimental to the rest of the group or guide will result in the client being given a warning, and if he/she continues in this unacceptable fashion will be asked to leave the tour for the safety of others and this again will exonerate the company from any responsibility towards costs or repatriation of the individual.
We would like to remind customers that the trails in Spain are not to be treated like an Enduro Circuit. We expect all riders to abide by local laws and to ride in a manner suitable to the surroundings.
Participant Behaviour - The tours we run are designed for the maximum enjoyment of all riders. Our tours are not designed as 'a race' and as such we ask all participants to behave in a responsible and courteous manner to all other riders, the public and our guides. Participants that are found to be riding in an irresponsible or dangerous manner will be cautioned and if this behaviour continues the guide will call an end to the participants tour without refund. Any riders found to be under the influence of alcohol or drugs will be refused participation without refund.
Motorcycle Damages - We will not charge the customer for minor damage incurred under normal riding circumstances such as low speed falls or accidentally dropping the bike. Damages caused by irresponsible riding or riding beyond your capabilities will be charged in full at cost. All TrailWorld equipment must be treated with respect and participants found abusing our equipment will be politely cautioned and if this behaviour continues, asked to leave without refund. The judgement of our guide or staff member is final and by booking with us you accept this statement. Please also note that should you participate in any of the OPTIONAL hill climb challenges, you do so at your own risk and will be liable for any motorcycle damages caused.
Non Participation - We will not refund riders any part of their fee if they choose not to participate of their own accord due to tiredness, injury, illness or similar, on any of their riding days whilst in Spain. In extreme cases we may, at our discretion, award you with a voucher to redeem against a future tour and only as a gesture of goodwill on our part.

Definitions |
1.1 |
‘the Activity’ means a guided trail riding tour provided by TrailWorld. |
1.2 |
‘Andalucian Trail Tours’ means TrailWorld Limited trading as TrailWorld. |
1.3 |
‘the Customer’ means the person who takes part in the activity. |
1.4 |
‘the Conditions’ means the terms and conditions set out in this document and any special terms and conditions agreed in writing by TrailWorld. |
1.5 |
‘the Contract’ means each and every contract for the provision of services between TrailWorld and the Customer. |
2 |
Terms and Conditions applicable: |
2.1 |
The Conditions apply to the Contract to the exclusion of all other terms and conditions. |
2.2 |
Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by TrailWorld. |
2.3 |
The Contract shall be formed at the time of acceptance by TrailWorld of a booking of an Activity by a Customer and payment of the deposit by that Customer. |
2.4 |
All customers must hold a full and valid motorcycle licence for the type of motorbike that will be used in the Activity and must be able to present it upon request. |
2.5 |
All Customers must be aged 25 or over to participate in an Activity. (not applicable on our private land) |
2.6 |
Each Customer shall pay to TrailWorld Limited a £50 non-refundable deposit in order to secure participation in the Activity. |
2.7 |
The balance of the amount due will be paid by the Customer by cheque or Credit Card to TrailWorld Limited 21 days prior to participating in the Activity. |
2.8 |
All cheques to be made payable to “TrailWorld Limited”. |
2.9 |
In the event that any property owned by TrailWorld is damaged or lost whilst in the customers possession, the cost of the item will be paid by the Customer. Damage to the motorcycles caused by negligence will be charged at cost. |
2.20 |
TrailWorld reserves the right to change the track locations due to weather conditions and the standard of ability of the Customer and will inform the Customer of any changes prior to the commencement of the Activity. Location is also subject to change should one of our guides become unavailable due to sickness or injury - TrailWorld will endeavour to give as much notice as possible in these circumstances. |
2.11 |
None of the provisions of the Conditions are intended to or will operate to confer any benefit on a person who is not made a party to the Contract. |
3 |
Force Majeure |
Neither party shall be liable for any default due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest, or other event beyond the reasonable control of either party. |

Customers Disclaimer and acknowledgment of Conditions |
By signing these Conditions the Customer confirms that he has read and understands these Conditions and acknowledges that:- |

He understands that the activity may be hazardous and freely agrees to voluntarily expose himself to risk of injury damage or loss |

Competitive riding and racing is not permitted |
c |
TrailWorld is not a training organisation and tour guides are on hand to give guidance on the route only |
d |
He is responsible for the way in which he uses the motorcycle and rides it during the activity |
e |
He will wear a helmet and the appropriate protective clothing during the Activity |
f |
He has disclosed to TrailWorld any medical condition or medication being taken and confirms that he is physically fit and does not suffer from any medical condition which may adversely affect his ability to control a motorcycle |
g |
He will not participate in the Activity whilst under the influence of alcohol or drugs |
h |
He acknowledges that TrailWorld shall not be liable for the death of or injury to the Customer or any loss or damage to the Customers property unless due to negligence or other failure of ITrailWorld to perform its obligations under this Contract or the general law. In the event of any breach of the Contract by TrailWorld the remedies of the Customer shall be limited to damages. Under no circumstances shall the liability of TrailWorld exceed the price of the Activity provided that nothing in these Conditions shall restrict or exclude liability for the death of or injury to the customer |

Law and Jurisdiction |
The Conditions and the Contract shall be governed by English Law and the Customer consents to the exclusive jurisdictions of the English Courts in all matters. |

Miscellaneous |
6.1 |
All headings are for ease of reference only and shall not effect the construction of the Conditions. |
6.2 |
Any provision contained in the Conditions which is or may be void or unenforceable shall to the extent of such invalidity or unenforceability be deemed severable and shall not effect any other provisions of the Conditions. |
